These Terms of Use ("Terms") govern your access to and use of OpModelHero (the "Service"), provided by Wishbones Ltd ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. The Service
OpModelHero is an online tool for capturing, visualising and managing enterprise-architecture information — including requirements, capabilities, actors, processes, applications, data, infrastructure and the interactions between them. We may add, change or remove features from time to time to improve the Service.
2. Accounts
You are responsible for the information you provide when registering, for keeping your login details secure, and for all activity that happens under your account. You must be at least 18 years old and able to enter into a binding agreement. Organisation owners and administrators are responsible for the members they invite and the permissions they grant.
3. Acceptable use
You agree to use the Service lawfully and not to: upload content you do not have the right to use; attempt to gain unauthorised access to the Service, other accounts, or our systems; interfere with or disrupt the Service; upload malware; scrape or copy the Service beyond normal use; or use the Service to store unlawful, infringing or harmful material.
4. Your content and data
You retain ownership of the content and data you and your organisation put into the Service ("Your Content"). You grant us a limited licence to host, process and display Your Content solely to operate and support the Service for you. You are responsible for the accuracy and legality of Your Content and for having the rights to upload any documents you import. Where you use AI features to import or classify documents, you remain responsible for reviewing and accepting the results.
5. Our intellectual property
The Service, including its software, design, branding and content we provide, is owned by us and our licensors and is protected by intellectual-property laws. These Terms do not transfer any of our intellectual property to you; you receive only a limited right to use the Service in accordance with these Terms.
6. Plans, trials and payment
Some features are offered under different plans or tiers, which may be free or paid. Where a plan is paid, the applicable fees, billing period and any trial terms will be shown before you subscribe. Unless stated otherwise, fees are non-refundable except where required by law.
7. Availability
We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. We may suspend the Service for maintenance, updates or reasons outside our reasonable control.
8. Privacy
Our handling of personal data is described in our Privacy Policy, which forms part of these Terms. Please review it to understand what we collect and how we use it.
9. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we exclude all warranties, whether express or implied, including fitness for a particular purpose. Enterprise-architecture outputs, cost figures and AI-generated suggestions are provided to assist your decisions, not to replace your own professional judgement.
10. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental or consequential loss, or for loss of profits, data or goodwill. Our total liability arising out of or in connection with the Service will not exceed the amount you paid us for the Service in the [12] months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.
11. Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms or use the Service in a way that risks harm to us, other users or third parties. On termination, your right to use the Service ends; provisions that by their nature should survive (such as ownership, disclaimers and limitation of liability) will continue to apply.
12. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to let you know. Continuing to use the Service after changes take effect means you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of the United Kingdom, and the courts of
United Kingdom will have exclusive jurisdiction, except where mandatory local law provides otherwise.
